Terms of Sale

The products purchased on www.semper-astra.com (the “products”) are sold by Semper Astra SAS, with its headquarters located at 17, rue de Paradis, 75010 Paris, registered with the Paris RCS under number 930 092 010, with VAT number FR38930092010.

These general terms and conditions are intended to define and govern any sale concluded between Semper Astra (the "seller") and any natural or legal person placing an order on the website www.semper-astra.com (the "customer").

I. Applicability and Enforceability of the Terms and Conditions

All orders placed on the website hosted at www.semper-astra.com (the "website") are subject to these general terms and conditions of sale, which constitute the entirety of the obligations between the parties, and whose acceptance is a determining factor without which the seller would not have entered into the contract.

The seller reserves the right to modify these general terms and conditions at any time. Any new version of the general terms and conditions of sale will apply from the date of its publication on the website, it being understood that the version applicable to the parties will be the one in effect on the date of the order.

II. Registration

Placing an order requires the customer to register on the website and to create an account including personal information. This registration shall be validated by the seller before issuance of a confirmation email to the customer.

Customers shall provide accurate and complete personal data when creating and updating their account. Where necessary, customers commit to amend and update them. They declare being of legal age and having the legal capacity to enter into a sale. For a company, the account is presumed to be created by a person having the authority to bind the entity.

In case of errors in the recipient’s details, the seller shall not be responsible for delivery failures. Furthermore, customers are responsible for the use of their identifiers and undertake to use them on a personal basis and not to disclose them to any third parties.

III. Orders

3.1 Order Placement Process

The customer who wishes to purchase any item proposed by Semper Astra shall:

  • Have a customer account created in accordance with Article 2 above,
  • Select the desired items and their quantities,
  • Validate the order after checking it,
  • In the case of a customized order, make a request directly to Semper Astra and accept the corresponding quote,
  • Make the payment under the conditions set out in Article 10 below, and
  • Wait to receive the order confirmation issued by the seller via email.

The customer's validation of their order on the website implies the express and unreserved acceptance of these general terms and conditions.

3.2 Product Availability

The seller prioritizes small stock quantities and the products are sold subject to their availability. Semper Astra also reserves the right to limit the quantity of products which may be ordered by a customer through one single transaction.

In the event that the requested product is unavailable, the seller, who commits to informing the customer via email or phone as soon as possible, shall not be held responsible for the cancellation of the corresponding order.

3.3 Special Orders (Custom and Personalization)

Customers may request custom jewelry or, when possible, personalization of available items. Requests shall be sent via the website’s contact form or by email to order@semper-astra.com.

In this case, Semper Astra provides the customer with a quote, valid for fifteen (15) days. After this period of time, a new quote shall be issued by the seller.

IV. Right of Withdrawal

4.1 General Provisions

In accordance with article L.221-18 of the French Consumer Code, the customer (when a consumer, as defined in said Code) has a period of fourteen (14) days from the receipt of the products to exercise their right of withdrawal without having to provide reasons or to pay any penalties, except for the return costs which shall remain their responsibility.

The customer may exercise their right of withdrawal by sending a written request by email to the following address: order@semper-astra.com. The return of the product, which shall be carried out by the customer in accordance with the stipulations of Article 4.3, shall be made within fourteen (14) days of the withdrawal notification, in its original packaging, intact, in perfect condition for resale, and accompanied by any and all accessories and by a copy of the purchase invoice.
The seller shall proceed with the refund of the corresponding amount, excluding return costs, within thirty (30) days following the receipt of the package.

4.2 Exclusions

Worn, damaged, soiled, or incomplete products will not be accepted. Any damage suffered by the product may invalidate the customer’s right of withdrawal. To ensure that the relevant product(s) meet these conditions, all returns will be subject to a rigorous quality control by Semper Astra. The seller thus reserves the right to refuse the relevant product(s) and not to refund or exchange it(them) based on its(their) quality condition.

Furthermore, the customer is informed that, in accordance with article L.221-28 of the French Consumer Code, a custom-made, personalized, or engraved piece of jewelry made at the customer's request cannot be returned, refunded, or exchanged.

4.3 Return Modalities

The return postal address shall be communicated to the customer by email. The return costs as well as the risks associated with the return of the relevant product(s) are borne by the customer. In this regard, the customer shall select a secure shipment (via Declared Value, FedEx or UPS), with proof of deposit and delivery and insurance covering loss, theft, or damage to the package during transportation. No "cash on delivery" returns shall be accepted, regardless of the reason.

V. Legal Warranties

The seller commits to adhering to the legal warranties of conformity and hidden defects as stipulated respectively in articles L.217-4 et seq. of the French Consumer Code and 1641 of the French Civil Code. The exercise of any of these warranties shall be requested in writing by email to the following address: order@semper-astra.com.

The claim shall be substantiated and accompanied by the corresponding proofs. The return of the product, which shall be carried out by the customer in accordance with the stipulations of Article 4.3, shall be made within fourteen (14) days of the initial notification, in its original packaging, intact, in perfect condition for resale, and accompanied by any and all accessories and by a copy of the purchase invoice.

The seller shall refund the corresponding amount, except for the return costs which remain the responsibility of the customer, within thirty (30) days following the receipt of the package.

VI. Products

Only products included in orders confirmed pursuant to Article 3 above are covered by the seller’s obligations.

The seller takes great care in presenting and describing its products on the website to satisfy customer information needs. Each product description includes photographs and essential features, which are given for information purposes only. Given that the jewels are handcrafted using natural materials, any description, including information regarding the number of pavé stones as well as the weight of metals and gemstones, may vary slightly from one creation to another. Likewise, despite the utmost care that the seller takes in presenting its items on the website, the seller cannot guarantee that their actual appearance will exactly match their on-screen representation. Variations in shades (of stones and metals) may occur, particularly due to the technical limitations of color rendering on computer equipment. The seller cannot be held liable for minor inaccuracies that may result from such differences.

Errors may be present on the website; when possible, Semper Astra commits to correcting them promptly upon notification. However, any error or delay in updating the website, regardless of its origin, shall not engage the seller's liability.

VII. Exchange and Refund

Except for legal provisions set out in Articles 4 and 5 above, the seller is not obliged to accept any exchange or refund requests. Any request shall be sent by email to order@semper-astra.com by the customer, who shall provide their first name, last name, telephone number, order number, and the reason for the return.

VIII. Delivery

The seller ships from Paris (France) and delivers in France and in most countries around the world. Orders are shipped within the timeframe indicated on the order validation page, to the address set out on the electronic invoice based on the information provided by the customer.

Once the order is validated by the seller, within three (3) business days, the customer shall receive an update on the preparation and delivery of their order:

  • When products are available and not subject to any engraving: orders are shipped within two (2) business days following the seller's order confirmation.
  • When products are made on demand: the email sent to the customer shall provide an indicative timeframe for preparation and delivery; generally, these products are ready to be shipped within 6 to 8 weeks following the seller's order confirmation.
  • When products are custom-made, according to the customer's instructions: an indicative timeframe for manufacturing and delivery shall be provided to the customer with the corresponding quote, it being understood that this manufacturing period shall start as soon as the quote is accepted by the customer.

Should the delivery time be longer than expected, the seller shall inform the customer by email. Should an order include several products, shipment may be split if some items are available sooner than others.

Delivery timeframes, which only start running from the day the order is paid for and confirmed, are given for informational purposes only, so that their non-compliance shall not give rise to withholding, compensation, or damages, nor shall it motivate the cancellation of ongoing orders. Deliveries are made based on stock availability, supply deadlines, and subject to potential technical difficulties. The seller shall not be held responsible for delivery delays caused by its suppliers, nor be liable for penalties or damages of any kind due to a delay or absence of delivery generated by a force majeure event or an unforeseeable circumstance. Force majeure encompasses all circumstances beyond the seller's control that result in a stoppage or reduction in production or delivery by its own suppliers. In case of a force majeure event, the seller's obligations shall be suspended without any formalities, thereby absolving the seller of any liability.

Upon receipt of their order, the customer must check the conformity of the received products. Any anomality concerning the delivery (missing or damaged product) shall be notified on the date of receipt or the first working day following receipt at the latest, at order@semper-astra.com, otherwise, the seller shall not commit to refunding the order.

IX. Prices

The prices are indicated in Euros or US Dollars depending on the chosen option and include value-added tax (VAT). They exclude delivery costs.

In the case of an order to be delivered in a country other than France, the customer unreservedly becomes the importer of the purchased product(s). For any order shipped outside the European Union, all applicable customs duties and/or taxes shall be borne by the customer exclusively.

The customer is informed that, if the payment is made from a country other than France, their bank may charge additional fees which shall be borne by the customer.

The seller reserves the right to modify its prices at any time. However, any such change shall not affect ongoing orders, which shall be invoiced based on the prices in effect at the time of the customer’s validation of their order.

X. Payments

10.1 General Information

The payment of the price and its accessories (including VAT and delivery costs) is due immediately following the completion of the order. The products remain the property of the seller until full payment of the price.

Payment may be made:

  • By credit card: the amount is debited immediately, triggering the confirmation and dispatch of the order.
  • By PayPal: the amount is debited immediately, triggering the confirmation and dispatch of the order.
  • By bank transfer: The transfer shall be completed within 7 (seven) days following the order for the order to be registered. The order registration date, which shall trigger its dispatch, is the date of receipt of the funds in Semper Astra's bank account.

When paying by credit card, the customer provides all the required banking data in a secure online environment. To ensure the confidentiality and security of banking data, control is carried out online with the competent banking establishments and organizations, via the STRIPE system, a payment service provider. The STRIPE company is responsible for the storage and automated processing of information related to each order, including bank details, in a secure environment.

The customer remains fully responsible for the banking information they provide and the security of their means of payment.

After completing their payment on the website, the customer shall receive an initial automatic payment confirmation email, followed by a second order confirmation email with a summary of the ordered items. This order confirmation email constitutes Semper Astra's acceptance of the customer's order, thus forming the sales contract between the parties.

The seller reserves the right not to confirm an order and not to register a payment for any reason. For example, Semper Astra may suspend, refuse, or cancel any order in case of supply issues, non-payment of an order, a refused credit card payment, a previous or current dispute with the customer, or for any other reason that Semper Astra will reserve the right to explain to its customer. Semper Astra may not be held liable in this regard.

10.2 Special Orders

The price of special orders, placed in accordance with the provisions of Article 3.3 above, shall be paid by the customer in two (2) installments:

  • Upon order validation, the customer shall pay a deposit of 50% (fifty percent) of the total order price, and
  • When the item is ready to be delivered or shipped, the customer shall be requested by email to pay the remainder, representing the remaining 50% (fifty percent) of the total order price; the customer shall then have seven (7) days from the date of the email to pay this amount. After this period, a fixed compensation of 40.00 € (forty Euros) shall be applied.

No product shall be delivered or shipped until the total price has been paid by the customer, with ownership of the items transferring to the customer only upon full payment of the price.

10.3 Invoice

An invoice shall be sent to you by email upon confirmation of your order. A paper invoice may also be sent, on demand, with the order.

XI. After-Sales Service

11.1 Reparations - Maintenance

The seller offers after-sales service only for items purchased directly from Semper Astra or on its website. To benefit from this service, the customer shall send a request to hello@semper-astra.com, specifying their needs and attaching a copy of their invoice. The customer shall return the relevant product in accordance with the instructions set out in Article 4.3. The seller shall check if the relevant product is eligible for after-sales service and, if so, shall inform the customer of the terms and modalities of its intervention before commencing any necessary work.

11.2 Ring resizing

The seller offers, at its own expense, the first resizing of any ring produced by Semper Astra and purchased directly from Semper Astra or on the website, provided that the request is made by the customer within one (1) month from the date of its purchase. The customer shall present the invoice corresponding to the relevant item. To preserve the integrity of the relevant piece of jewelry (including its setting), it is specified that rings may only be resized by a maximum of one (1) to three (3) sizes depending on the considered model and that resizing will not be possible for some specific models of rings. The seller will inform the customer of the options available. If resizing is possible, the customer will be invited to return the relevant product in accordance with the instructions set out in Article 4.3.

XII. Intellectual Property Rights

All elements appearing on the website, whether visual or otherwise, as well as the products sold on the website, are protected by copyright and other intellectual property rights. They are the exclusive property of Semper Astra or its partners. No transfer of intellectual property rights is completed through these general terms and conditions of sale. Any unauthorized reproduction, representation, adaptation, or exploitation of any or all of these elements is strictly prohibited.

XIII. General Provisions

13.1 Invalidity of a Clause

The invalidity of any provision hereof, for any reason whatsoever, shall not affect the validity of the other provisions, provided that the overall economic purpose of these general terms and conditions of sale is preserved. In such a case, the parties agree to replace the declared illegal, invalid, or unenforceable provision with a legal, valid, and enforceable provision that is as similar as possible in its effects.

The fact that the seller does not, at any time, enforce any of the provisions herein shall not be interpreted as a waiver of the right to enforce them at a later date.

13.2 Applicable Law and Dispute Resolution

If a dispute cannot be resolved amicably with Semper Astra’s customer service, the customer may resort to the following consumer mediation service, free of charge, under the conditions provided by the French Consumer Code regarding the amicable resolution of disputes. Semper Astra is affiliated with the CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice)mediation service, whose contact details are as follows:

The customer may also submit their dispute via the European online dispute resolution platform, accessible here: https://ec.europa.eu/consumers/odr.

In the absence of an amicable solution, the dispute will be brought before the competent French courts. In any case, only French law shall apply to these general terms and conditions of sale.
